TERMS AND CONDITIONS OF PURCHASE
1. INTRODUCTION
This document (together with all other documents mentioned herein) sets out the terms and conditions governing the use of this website and the purchase of products through this website (hereinafter referred to as the “Conditions”). The Customer must read the Conditions, our Cookie Policy, and our Privacy Policy (collectively referred to as the “Data Protection Policies”) before using the website. By using this website or placing an order through it, you, our valued customer, acknowledge, declare, and undertake that you consent to be bound by these Conditions and the Data Protection Policies. If the Customer does not agree to all the Conditions and Data Protection Policies, they should not use the website. These Conditions and Data Protection Policies are subject to change. It is the Customer’s responsibility to read them regularly, and the “Conditions and Data Protection Policies” in effect at the time the Customer uses the website or creates the Contract (as described below) shall apply.

3. YOUR INFORMATION AND VISITS TO THE WEBSITE
The Customer must provide personal information to purchase the desired product. Information or personal data shared with Marau is processed in accordance with the Data Protection Policy. By using the website, the Customer confirms that all information shared with Marau is accurate and true and consents to the processing of this information and personal data. If the Customer explicitly declares interest to Marau, Marau may inform the Customer about the latest collections, catalogs, campaigns, and special offers via mail, e-mail, and/or SMS.
4. USE OF THE WEBSITE
By using the website and/or placing any order through the website, the Customer agrees, declares, and undertakes:
1. To use the website only for legitimate inquiries or orders.
2. Not to place unrealistic, unfounded, or fraudulent orders; Marau reserves the right to cancel the order and inform the relevant authorities if it has reasonable grounds to believe such an order has been made.
3. To provide Marau with accurate and up-to-date e-mail, postal, and/or other contact information and acknowledges that Marau may use this information to contact the Customer if necessary (see Data Protection Policy).
If the Customer does not provide all the information required to complete the order, Marau may not complete the order. By placing an order through the website, the Customer confirms that they are at least 18 years of age and legally capable of entering into binding contracts.
5. SERVICE AVAILABILITY
The products offered on this website are available for delivery only within the borders of the Republic of Türkiye.
6. FORMATION OF THE CONTRACT
To place an order, the Customer must follow the online purchase process and click “Confirm Payment.” After doing so, the Customer will receive an e-mail acknowledging receipt of the order (“Order Confirmation”). In a subsequent second e-mail, the Customer will be informed that the order has been accepted and is being dispatched (“Delivery Confirmation”). If Marau has not provided such confirmation to the Customer, the contract is deemed not to have been established.
7. REFUSAL OF ORDER
Marau reserves the right to withdraw any product from the website at any time and/or remove or edit any materials or content on the website. Although Marau will make every reasonable effort to process all orders submitted, it reserves the right to refuse to fulfill or confirm an order after receiving it or after sending an “Order Confirmation” to the Customer in the event of extraordinary circumstances. Marau shall not be liable to the Customer or any third party for withdrawing any product from the website, removing or editing any material or content, or refusing to fulfill or confirm an order after receiving it or sending the “Order Confirmation.”
8. DELIVERY
Unless extraordinary circumstances occur, Marau shall deliver the orders for the products listed in the Delivery Confirmation by the delivery date specified therein, or if no estimated delivery date is specified, within a maximum of thirty (30) days from the “Order Confirmation” date. If the products are delayed due to circumstances beyond Marau’s control, Marau will inform the Customer as soon as possible and take measures to minimize the effect of the delay. Marau shall not be responsible for delays caused by circumstances beyond its control. However, if there is a risk of significant delay, the Customer may contact Marau to terminate the contract and receive a refund for products paid for but not received.
Marau requests the Customer to remove any fragile items or obstacles to minimize the risk of damage to the home or property and to accept delivery personnel in the most convenient manner. Unless caused by Marau’s negligence, Marau cannot be held responsible for situations where reasonable precautions could have been taken to prevent or minimize risk. For the purposes of these Conditions, “delivery” or “delivered” shall be deemed to have occurred upon the Customer or a third party designated by the Customer (other than the carrier) acquiring physical possession of the products, which shall be evidenced by signing the receipt for the products at the designated delivery address.
9. INABILITY TO DELIVER
If delivery is not possible, the product(s) will be returned to the warehouse. In such a case, the Customer will be informed regarding the location of the product and how to reschedule the delivery. If the Customer is not at the delivery location at the agreed time, they must contact Marau to rearrange delivery for another suitable day. If the product is brought to the delivery address but delivery cannot be completed for reasons not attributable to Marau, and the Customer does not contact Marau for delivery within the following fifteen (15) days, the contract may be terminated on the grounds of breach of contract. As a result of the termination of the contract, Marau shall refund all payments received from the Customer, including delivery costs (excluding additional costs arising from any delivery method requested by the Customer other than the standard delivery method offered by Marau), without any unreasonable delay and in any case within fourteen (14) days after the termination of this contract. The Customer should note that there may be additional costs for shipping arising from the termination of the contract, and Marau shall have the right to reflect these costs to the Customer.
10. RISK AND OWNERSHIP
As long as the Customer accepts delivery via the courier/cargo company designated by Marau, all benefits and risks regarding the products shall be Marau’s responsibility until delivery. Ownership of the products passes to the Customer upon delivery of the product to the Customer or a person present at the delivery address (Transfer of Ownership).
11. PRICE AND PAYMENT
The price of the products is as determined on the website. Although Marau makes every effort to ensure all prices on the website are accurate, errors may occur. In the event of a pricing error for products ordered, Marau will inform the Customer as soon as possible and offer the option to confirm the order at the correct price or cancel it. If Marau cannot reach the Customer, the order will be deemed canceled, and the amount paid for the products will be refunded. If a pricing error is obvious and unmistakable and could have reasonably been recognized by the Customer as a mispricing, Marau is not obligated to complete the sale at the incorrect (lower) price (even after sending a delivery confirmation). Prices on the website include VAT and taxes but exclude delivery fees, which will be added to the total amount as specified in the “Shopping Guide.” Prices may change at any time, but (except as stated above) price changes will not affect orders for which an “Order Confirmation” has been sent. Therefore (except as stated above), price adjustments for previous orders are not permitted. Once the Customer completes shopping, all items are added to the basket; the next step is checkout and payment. The Customer must follow the steps, providing or confirming the requested information at each stage. Before payment, the Customer can modify order details. Before confirmation, a summary including the basic qualities of the product, total price including taxes, terms for the right of withdrawal (if applicable), and carrier information will be presented. Payments are made via credit and debit cards using the methods shown on the website. Credit card information is encrypted to prevent unauthorized access.
